It is LLiquida’s daily commitment to protect the online privacy of Website users, according to what we believe to be the principles to be respected.

In general, any information or personal data you provide to LLiquida through the Website, or that is collected in any other way through the Website, in the context of the use of the services we offer (the “Services”), as further defined in the subsequent Paragraph 3, will be processed according to the internationally recognized principles of lawfulness, fairness, transparency, purpose limitation and storage limitation, data minimization, accuracy, integrity, and confidentiality.

LLiquida, as identified at the beginning of this Policy, is the Data Controller with respect to all personal data processed through the Website.

2. Personal Data Subject to Processing

Following the browsing of the Website, we inform you that LLiquida will process information concerning you, which may consist of – also depending on your decisions on how to use the Services – an identifier such as name, identification number, online identifier or one or more characteristic elements of your physical, physiological, psychological, economic, cultural or social identity capable of identifying you or making you identifiable (hereinafter only “Personal Data”).

Your Personal Data may be collected either because you voluntarily provided it (e.g., when you subscribe to the Newsletter) or simply by analyzing your behavior on the Website.

The Personal Data processed through the Website are as follows:

Name, contact details, and other Personal Data

In various sections of the Website, you will be asked to enter information such as your name, email address, country of residence, address, etc.

Furthermore, every time you participate in surveys or any promotions made available through the Website, as well as when you communicate with LLiquida or with Customer Care through the contacts found on the Website, LLiquida may collect additional information that you decide to provide.

Special categories of personal data

Some sections of the Website include free fields where you can provide LLiquida with some information, which may contain Personal Data.

Since these fields are free, you may use them to communicate (voluntarily or not) certain sensitive categories of Personal Data, such as data capable of revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data intended to uniquely identify a natural person, data concerning health or sex life or sexual orientation of the person.

LLiquida invites you not to send such Personal Data unless strictly necessary. Indeed, since the insertion of such information is entirely optional, please consider that such special categories of Personal Data can only be processed with your explicit consent and in compliance with the current applicable legislation. LLiquida therefore emphasizes the importance of manifesting your explicit consent to the processing of special categories of Personal Data, should you decide to share such information.

Data of third parties provided by the data subject

As already mentioned above, in some parts of the Website, you are allowed to insert text messages, visible to LLiquida, which may contain (voluntarily or not) Personal Data of other people.

With regard to such hypotheses, you act as an autonomous data controller, assuming all legal obligations and responsibilities. In this regard, you provide LLiquida with the broadest indemnity with regard to any dispute, claim, request for compensation for damage from treatment, etc. that may be received by LLiquida from third parties whose Personal Data have been processed through your use of the Website’s functions in violation of the rules on the protection of personal data applicable.

In any case, if you provide or otherwise process Personal Data of third parties in using the Website, you guarantee from now on – assuming all related responsibilities – that such particular processing is based on the consent of such third party concerned or on another suitable legal basis legitimizing the processing of the information in question.

Browsing data

The computer systems and software procedures used to operate the Website acquire, during their normal operation, some Personal Data whose transmission is implicit in the use of Internet communication protocols. These are information that is not collected to be associated with identified data subjects but, by their very nature, could, through processing and association with data held by third parties, allow users to be identified.

This category of data includes IP addresses or domain names of the computers used by users who connect to the Website, URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.), and other parameters relating to the user’s operating system and computer environment.

These data are used solely to obtain anonymous statistical information on the use of the Website and to check its correct functioning, to identify anomalies and/or abuses. Except in cases where the data are used to ascertain responsibility in case of hypothetical computer crimes against the site or third parties, such data do not persist for more than seven days.

3. Purpose of Processing

LLiquida will use your Personal Data collected through the Website for the following purposes:

Send you the newsletter you requested as a Service; send you any information you have explicitly requested; find the dealer closest to you and provide you with any other Service you request (“Service Provision”);

Send you communications and/or commercial offers and/or any informative material relating to our brands and models, invite you to events (public or private), fairs, and/or boat shows, send you promotional communications, market research, and surveys relating to the products and services offered by LLiquida or transmit our magazine to you. Depending on the type of communication, the channels may be email and/or telephone and/or messaging services and/or postal mail and/or social networks (Marketing);

To create a profile of you through the use of profiling cookies, where accepted, by collecting and analyzing information about the selections and choices you make on the Website, as well as your general activities on the Website. This profile will be used to provide you with information about other sites and/or services that LLiquida believes may interest you and to show you advertisements that may be relevant to your tastes. All algorithms involved in this process are regularly tested to ensure the correctness of the process and the prevention of errors (“Preferences”);

To comply with legal obligations that require LLiquida to collect and/or further process certain types of Personal Data (“Compliance with legal terms”);

To prevent or detect any abuse in the use of the Website or any fraudulent activity (“Abuses/Fraud”).

4. Legal Basis and Mandatory or Optional Nature of Processing

The legal bases used by LLiquida to process your Personal Data, according to the purposes indicated in the previous Paragraph 3, are as follows:

Service Provision: processing for this purpose is necessary in order to provide you with the Services and, therefore, for the performance of the contract in force with you. The provision of your Personal Data to LLiquida for this purpose is not mandatory, but otherwise it will not be possible to provide you with any Service.

Marketing: processing for this purpose is based on your consent. It is not mandatory to give your consent for this purpose but, in the absence of your consent, we will no longer be able to send you any type of communication, including commercial communications regarding our products or invite you to events and/or fairs. If you give your consent, you are still free to revoke it at any time following the instructions in Paragraph 8 of this Policy.

Preferences: processing for this purpose is based on your consent collected through the cookie banner and/or a specific checkbox. It is not mandatory to give your consent to LLiquida for this purpose and you are free to revoke it at any time without any consequence (other than not being able to benefit from LLiquida’s commercial offers customization). You may revoke the consent previously given by following the instructions in Paragraph 8 of this Policy.

Compliance with legal terms: processing for this purpose is necessary for LLiquida to fulfill any legal obligations. When you provide Personal Data to LLiquida, they will be processed in accordance with applicable law, which may involve their retention and communication to the Authorities for accounting, tax, or other obligations.

Abuses/Fraud: the information collected for this purpose will be used exclusively to prevent and/or detect any fraudulent activities or abuses in the use of the Website (with criminal relevance).

5. Recipients of Personal Data

Your Personal Data may be shared with the following designated recipients (“Recipients”):

Subjects acting typically as data processors, namely: i) individuals, companies, or professional firms that provide assistance and advice to LLiquida in accounting, administrative, legal, tax, financial matters, and credit recovery related to the provision of Services;

Subjects with whom it is necessary to interact for the provision of Services (such as hosting providers or platform providers for sending emails);

Subjects delegated to perform technical maintenance activities (including maintenance of network equipment and electronic communication networks);

Persons authorized by LLiquida to process Personal Data necessary to perform activities strictly related to the provision of Services, who have committed themselves to confidentiality or have an adequate legal obligation of confidentiality (e.g., LLiquida employees);

LLiquida companies for internal administrative purposes, including the processing of Personal Data of customers and employees;

Subjects, entities, or authorities to whom it is mandatory to communicate your Personal Data for Compliance, Abuses, or Frauds purposes, or for orders from the authorities;

6. Transfer of Personal Data

Given the international presence of LLiquida, some of your Personal Data are shared with Recipients that may be located outside the European Economic Area. LLiquida ensures that the processing of your Personal Data by these Recipients is carried out in compliance with applicable law. Indeed, transfers are made through adequate safeguards, such as adequacy decisions, Standard Contractual Clauses approved by the European Commission, or other guarantees considered adequate. 7. Retention of Personal Data

Personal Data processed for the purpose of Service Provision will be kept by LLiquida for the time strictly necessary to achieve the aforementioned purpose. In any case, since such Personal Data are processed to provide you with the Services, LLiquida may keep them for a longer period, particularly as may be necessary to protect LLiquida’s interests from possible liabilities related to the Services.

Personal Data processed for Marketing and Preferences purposes will be kept by LLiquida until the consent you have given is revoked and periodically renewed. Once the consent is revoked, LLiquida will no longer use your Personal Data for these purposes, but may still keep them, particularly as may be necessary to protect LLiquida’s interests from possible liabilities based on such processing.

Personal Data processed for Compliance with legal terms purposes will be kept by LLiquida for the period provided for by specific legal obligations or applicable regulations.

Personal Data processed to prevent Abuses/Fraud will be kept by LLiquida for the time strictly necessary for the aforementioned purpose, and therefore until LLiquida is required to keep them to protect itself in court or to communicate said data to the competent Authorities.

8. Rights of the Data Subject

You have the right to ask LLiquida, at any time:

Access to your Personal Data, (and/or a copy of such Personal Data), as well as further information about ongoing processing on them;

Rectification or updating of your Personal Data processed by LLiquida, where they are incomplete or not up to date;

Erasure of your Personal Data from LLiquida’s databases, where you consider the processing unnecessary or unlawful;

Limitation of the processing of your Personal Data by LLiquida, where you believe that your Personal Data are incorrect, unnecessary, or are unlawfully processed, or where you have objected to their processing;

To exercise your right to data portability, i.e., to obtain in a structured, commonly used, and machine-readable format a copy of the Personal Data provided to LLiquida concerning you, or to request their transmission to another Controller;

To object to the processing of your Personal Data by LLiquida, using a legal basis related to your particular situation, which you believe should prevent LLiquida from processing your Personal Data; or to revoke your consent for Marketing and Preferences purposes.

Please note that most of the Personal Data you have provided to LLiquida can be modified at any time, including your preferences regarding email, via email at info@lliquida.com.

At the time of requesting the Services, you may have selected the communication channels through which you want to be contacted for Marketing purposes (such as fax, telephone, SMS, email, postal mail, social media).

You can revoke consent for Marketing related to each of these communication channels by email using the specific link found at the bottom of each email received. The same method can be used to stop receiving LLiquida’s newsletter if you have requested it as a Service.

Consent to Profiling through cookies can be revoked at any time by writing to LLiquida at the following address: info@lliquida.com.

In any case, you always have the right to lodge a complaint with the competent Supervisory Authority if you believe that the processing of your Personal Data is contrary to applicable law.

9. Changes

This Policy is effective as of 25/05/2018. LLiquida reserves the right to modify or simply update its content, in whole or in part, also due to changes in applicable law. LLiquida will inform you of such changes as soon as they are introduced and they will be binding as soon as they are published on the Website. LLiquida therefore invites you to visit this section regularly to become aware of the most recent and updated version of the Policy in order to always be informed about the Personal Data collected and how LLiquida uses it.
